Privacy Policy

This site (mackey.ch) is the personal website and portfolio of Jason Mackey ("Jason," "I," "me," or "my"). The site is operated by me as an individual; no separate legal entity is behind it. I built the site to share who I am, what I work on, and a few small interactive tools I made for fun. This Privacy Policy describes the limited information the site collects, what I do with it, and the choices you have.
If you become a client of any of my ventures through a separate written engagement, the information you share in that engagement is governed by the terms of that engagement and is not the subject of this policy.
1. Information I Collect
I try to collect as little personal information as possible.
Information you give me directly.
- Contact form ("Send a Message"). If you send a message through the desktop's compose window, I receive your name, email address, and the contents of your message.
- Owner Score (interactive tool). If you complete the Owner Dependency Score, I receive your answers to the questionnaire and any contact information or business context you choose to share so I can return your report.
- AI Opportunity Scanner (interactive tool). If you submit the Scanner form, I receive your business name, industry and sub-industry, employee count, annual revenue band, the hours per week your team spends on repetitive admin, the manual processes you select, the tools you currently use, the operational bottleneck you describe in your own words, and your email address.
You decide what to share. You do not have to use the tools or the contact form to read the rest of the site.
Information collected automatically. The site is hosted on Cloudflare Pages. Cloudflare records standard server-log information needed to deliver the site, including your IP address, browser type and version, the URL requested, the referring page, and the time of the request.
Browser storage. The site stores a few small values in your browser's local storage so the desktop "remembers" how you left it across visits. These values live on your device — they are not transmitted to me or to any third party:
jm-desk-icons — the positions of the desktop icons after you drag them.
jm-wallpaper-v2 — the wallpaper you selected in Display Properties.
jm-seen-bio-v1 — whether the welcome bio has already been shown.
You can clear these at any time by clearing browser data for mackey.ch. The site does not set advertising, analytics, or third-party tracking cookies.
I do not collect Social Security numbers, government identification numbers, payment information, financial-account information, or other sensitive personal information through the site.
2. How I Use Information
I use the limited information described above to:
- Respond to inquiries and follow up on requests you initiate;
- Generate the report you requested from Owner Score or the AI Scanner, display it back to you, and send a notification copy to my inbox;
- Operate, maintain, and secure the site;
- Improve the design and copy of the site and its tools based on aggregate patterns of use;
- Comply with applicable law and respond to lawful requests.
I do not sell, rent, share, or trade personal information for advertising or marketing. I do not run behavioral advertising. I do not build profiles about you across other websites.
3. AI and Automated Processing
The Owner Score and AI Opportunity Scanner tools generate their reports by sending the information you submit to a third-party large-language-model provider (Anthropic) for analysis. Anthropic processes the prompt under its own terms (including its commercial API data-handling terms) and does not train its models on this content. The model's output is then displayed back to you and emailed to me as a notification of your submission.
The reports are produced by a language model. They are general, automated, and may contain mistakes. Treat them as a starting point for a conversation — not as professional advice. See the Terms of Service for more.
4. Service Providers
The site relies on a small number of service providers to function:
- Cloudflare Pages — hosts the site, serves it through a content-delivery network, and runs the backend functions that process the Owner Score and AI Scanner submissions. Processes your IP address and request metadata.
- Web3Forms — receives contact-form submissions and forwards them to my inbox. Processes your name, email, and message.
- Anthropic — runs the language model that produces the Owner Score interpretation and the AI Scanner report. Processes the form fields you submit to those tools.
- Resend — delivers the result-notification email after you complete a tool. Processes the submission summary and your email address.
- Google Fonts — loads the typefaces used in the site. Google may receive standard request information when a font file is fetched.
- Spotify — provides the embedded media player. If you press play on a track, Spotify loads its own resources and may set its own cookies in its iframe.
I have no other tracking, analytics, or advertising integrations on the site. When you click an outbound link to LinkedIn, X, Threads, Instagram, my Substack, or any other external service, you leave my site and the destination's privacy practices apply.
5. Data Retention
I retain contact-form messages and tool submissions for as long as they are useful to a conversation I am having with the person who sent them, after which I archive or delete them. Cloudflare logs are retained according to Cloudflare's own retention policies. Email retained in my inbox follows my normal email-retention practices.
You may ask me to delete the messages or submissions you have sent at any time.
6. Your Rights
Depending on where you live, you may have rights regarding your personal information:
California (CCPA / CPRA). You have the right to know what personal information I have collected about you, to request deletion or correction, to opt out of the sale or sharing of personal information (I do not sell or share personal information), to limit the use of sensitive personal information (I do not collect any), and not to be discriminated against for exercising these rights.
Other U.S. states. Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and other states with comprehensive privacy laws have similar rights, including the right to access, correct, delete, and obtain a portable copy of their personal information.
European Economic Area and United Kingdom. If you are located in the EEA or the UK, you have rights under the GDPR or UK GDPR, including the right to access, correct, delete, restrict, or object to processing of your personal information, and the right to data portability. The legal basis for the limited processing described above is my legitimate interest in operating the site and responding to inquiries, or your consent when you submit a form.
To exercise any of these rights, email me at nathan.hale@legal.mackey.ch. I may need to verify your identity before responding to certain requests.
7. Children
The site is intended for an adult professional audience and is not directed to children under 16. I do not knowingly collect personal information from children.
8. Security
I take reasonable measures to protect the limited personal information the site touches, including TLS in transit and access controls on the inbox where contact submissions land. No method of internet transmission or electronic storage is completely secure, and I cannot guarantee absolute security.
9. International Visitors
The site is operated from the United States. If you visit from outside the United States, you understand that information about you may be transferred to and processed in the United States and in the countries where the service providers listed above operate, where data-protection laws may differ from those in your jurisdiction.
10. Changes to This Policy
I may update this Privacy Policy from time to time. The Effective date at the top reflects the latest revision. Material changes will be reflected here; continued use of the site after a change constitutes acceptance of the revised policy.

These Terms of Service ("Terms") govern your access to and use of the website at mackey.ch (the "Site"), which is operated by Jason Mackey ("Jason," "I," "me," or "my") as an individual. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Who I Am
I am Jason Mackey — a founder, operator, and investor. The Site is my personal website, operated by me as an individual (no separate legal entity is behind it). It introduces who I am, lists the ventures I am involved in, and offers a couple of small interactive tools I built for fun and to help business owners think about a few things I care about.
2. The Site Is Informational and Personal
The Site provides general information about me, my career, and my interests. Nothing on the Site is legal, tax, accounting, financial, investment, medical, or any other kind of professional advice. The information on the Site is not a substitute for advice tailored to your specific situation.
3. The Interactive Tools Are For Education and Entertainment Only
The Site includes a small set of interactive tools — currently the Owner Score and the AI Opportunity Scanner — that ask you a handful of questions and return a report generated, in part, by a large language model.
- The reports are automated outputs of an AI model. They can be wrong, incomplete, generic, or oddly specific. Treat them as conversation starters, not as recommendations to act on.
- The reports are not legal, tax, accounting, financial, investment, medical, or any other kind of professional advice.
- Using a tool does not create any client relationship, advisory relationship, fiduciary duty, or other legal duty on my part.
- I make no warranty as to the accuracy, completeness, or fitness for any purpose of any tool output.
If you act on something a tool said, you do so at your own risk. When the stakes matter, talk to a qualified professional who knows your situation.
4. I Do Not Provide Investment Advice or Regulated Financial Services
I do not provide investment advice, offer securities, manage assets, or engage in any regulated financial services through the Site. I do not act as a fiduciary, broker-dealer, investment adviser, or in any similar regulated capacity through the Site. Nothing on the Site is an offer or solicitation of any security, investment product, or financial service.
5. Engagements Begin Only by Written Agreement
Any professional or advisory relationship with me, or with any entity I am affiliated with, begins only upon execution of a written engagement letter signed by both parties. Visiting the Site, sending a message through the contact form, submitting one of the interactive tools, or otherwise interacting with the Site does not create an engagement, an advisory relationship, or any other legal duty on my part.
6. Intellectual Property
The Site — including its text, design, code, layout, and visual elements — is owned by me or my licensors and is protected by United States and international intellectual-property laws. You may view and read content on the Site for personal, non-commercial purposes. You may not copy, modify, adapt, distribute, sell, or use any portion of the Site for commercial purposes without my prior written consent.
The "jdmackey" wordmark and the desktop-interface visual treatment of the Site are mine. Logos and marks of third-party ventures referenced on the Site belong to their respective owners.
7. User Conduct
You agree not to:
- Use the Site in violation of any applicable law or regulation;
- Interfere with the Site's operation, security, or availability;
- Reverse engineer, scrape, or systematically extract content or model outputs from the Site;
- Submit input to the interactive tools that is unlawful, harassing, defamatory, infringing, or that includes other people's personal information without their permission;
- Use the Site, or any tool output, to harm or harass any person;
- Use the Site to transmit malware, harmful code, or other malicious content;
- Misrepresent your identity, affiliation, or business when contacting me or submitting a form.
I may rate-limit, block, or otherwise restrict access at any time, with or without notice.
8. Third-Party Links and Services
The Site links to and embeds third-party services, including but not limited to LinkedIn, X, Threads, Instagram, Substack, Spotify, Cloudflare, Web3Forms, Anthropic, Resend, and Google Fonts. I do not control or endorse those services and am not responsible for their content, practices, or policies. Your use of any third-party service is at your own risk and is subject to that service's own terms.
9. Disclaimers
The Site, and every output of every interactive tool on the Site, is provided on an "as is" and "as available" basis without warranty of any kind, express or implied. To the fullest extent permitted by law, I disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and availability.
I do not warrant that the Site will be uninterrupted, error-free, or secure, or that any content or model output is accurate, current, or complete.
10. Limitation of Liability
To the fullest extent permitted by applicable law, in no event will I, or any entity I am affiliated with, be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Site or any output of any interactive tool on the Site, even if advised of the possibility of such damages. My total cumulative liability for all claims arising out of or related to the Site shall not exceed one hundred United States dollars (USD $100).
Nothing in this Section limits liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify and hold me harmless from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, your misuse of the Site or its interactive tools, or your violation of any law or any third party's rights.
12. Governing Law and Forum
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Suffolk County, Massachusetts, and you consent to the personal jurisdiction of those courts.
13. Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force and effect.
14. Changes to These Terms
I may update these Terms from time to time. The Effective date at the top reflects the latest revision. Continued use of the Site after a change constitutes acceptance of the revised Terms.
